Portugal's New Nationality Law Just Signed – Key Updates for 2026!



President António José Seguro promulgated the revised Portuguese Nationality Law on May 3, 2026, after Parliament's approval on April 1. Publication in the Diário da República is imminent, triggering entry into force.


Major Changes Impacting Clients:


  • Residency Requirement: Now 10 years for non-EU (up from 5); 7 years for EU/CPLP citizens – counted from permit issuance.

  • New Hurdles: A2 Portuguese test (lusophone exemption), culture/history exam, stricter criminal record checks (e.g., 3+ year sentences).

  • Born in Portugal? Tighter rules for children's citizenship.


Good News: Transitional rules protect pending CITIZENSHIP applications under old criteria.

The new Portuguese Nationality Law provides no special exemption or shorter residency timeline for holders or applicants of the "Autorização de Residência para Investimento"

(ARI), Portugal's Golden Visa program.


The law treats Golden Visa residency as standard "legal residence," subject to the same rules as other permits. Only pending nationality applications (not residency permits) receive transitional protection.


Practical Impact:

- ARI holders need full 10 years from first permit issuance.

- Pending citizenship applications are protected under old rules.
